Shipping policy

This Shipping Policy applies to orders placed with EBI Fabrics Corp. (“EBI,” “we,” “us,” or “our”). This policy should be read together with our Terms and Conditions of Sale and Website Use and Refund Policy.

 

SECTION 1 - SHIPPING CHARGES

EBI does not charge shipping for color cards or swatch cards shipped within the United States, unless otherwise stated at the time of request or order.

For color cards or swatch cards shipped outside the United States, the customer is responsible for all applicable international shipping charges, customs duties, taxes, import fees, brokerage fees, tariffs, and other related charges.

For fabric orders, the customer is responsible for all applicable shipping charges. Shipping charges may include carrier fees, freight charges, handling, insurance, delivery charges, and other shipping-related costs.

Shipping charges may be estimated at the time of order and may be adjusted to reflect actual carrier, freight, handling, insurance, or delivery charges.

Original shipping charges are nonrefundable unless EBI determines that the issue was due to EBI’s error or another reason required by applicable law.

 

SECTION 2 - ORDER PROCESSING

For all orders, orders are received and reviewed by EBI, after which we confirm the order details and provide a packing list for customer confirmation. Shipment will proceed only after the customer approves the packing list and full payment is received.

Processing may include checking availability, cutting fabric, preparing rolls or packages, confirming shipping details, and arranging shipment.

Special orders, custom orders, factory orders, and production orders may require additional processing time, approvals, and a 30% deposit before we proceed with production, along with any remaining balance payments as applicable.

Processing times are estimates only and are not guaranteed.

 

SECTION 3 - SHIPPING AND DELIVERY TIMES

All shipping and delivery dates are estimates unless EBI expressly guarantees a delivery date in a signed written agreement.

EBI is not responsible for delays caused by:

  • Carriers
  • Freight companies
  • Customs
  • Ports
  • Suppliers
  • Factories
  • Weather
  • Labor disruptions
  • Material shortages
  • Government actions
  • Customer delays
  • Incorrect shipping information
  • Events outside EBI’s reasonable control

Delivery delays do not automatically qualify an order for cancellation, refund, or credit unless required by applicable law or expressly agreed by EBI in writing.

 

SECTION 4 - SHIPPING ADDRESS

The customer is responsible for providing a complete, accurate, and deliverable shipping address.

EBI is not responsible for delays, additional charges, refused delivery, missed delivery, returned packages, redelivery fees, address correction fees, storage fees, or lost shipments caused by incorrect or incomplete shipping information provided by the customer.

If an order is returned to EBI because of an incorrect address, refused delivery, missed delivery, or failure to receive the shipment, the customer may be responsible for additional shipping, handling, storage, or redelivery charges.

 

SECTION 5 - SHIPPING METHODS AND CARRIERS

EBI may use shipping carriers, freight companies, courier services, customer-arranged carriers, or other delivery methods depending on the order size, destination, and product type.

For larger fabric orders, roll shipments, freight shipments, or commercial deliveries, additional shipping arrangements may be required.

If the customer requests a specific carrier, shipping account, freight company, or delivery method, EBI may accommodate the request at its discretion.

Customer-arranged shipping or pickup must be approved by EBI in advance.

 

SECTION 6 - CUSTOMER PICKUP

If customer pickup is approved, the customer must pick up the order at the time and location arranged with EBI.

The customer, the customer’s employee, the customer’s agent, or the customer’s arranged carrier is responsible for inspecting and accepting the shipment at pickup.

Once the goods are released for pickup, the customer is responsible for any loss, theft, delay, damage, or handling issues that occur after release, except to the extent caused by EBI before release.

 

SECTION 7 - TITLE AND RISK OF LOSS

Unless otherwise stated in a written quotation, sales order, invoice, or shipping agreement, EBI’s standard shipping terms are shipment terms.

For orders shipped by carrier, title and risk of loss pass to the customer when EBI properly delivers the goods to the carrier for shipment, even if EBI helps arrange shipping, provides shipping estimates, collects shipping charges, or provides tracking information.

For orders picked up by the customer, the customer’s employee, the customer’s agent, or the customer’s arranged carrier, title and risk of loss pass to the customer when the goods are made available for pickup and released to the customer or the customer’s representative.

After title and risk of loss pass to the customer, EBI is not responsible for loss, theft, delay, damage, misdelivery, carrier handling, weather events, customs delay, refused delivery, missed delivery, or other events occurring during or after transit, except to the extent caused by EBI before the risk of loss passed.

The customer is responsible for filing claims directly with the carrier for goods lost or damaged in transit after risk of loss has passed. EBI may, at its discretion, assist the customer with reasonable documentation needed for a carrier claim.

Nothing in this section limits the customer’s rights for goods that were defective, incorrect, or nonconforming before risk of loss passed, to the extent such rights cannot be waived under applicable law.

 

SECTION 8 - DAMAGED, LOST, OR DELAYED SHIPMENTS

Please inspect your shipment promptly upon delivery.

If a package appears damaged at delivery, the customer should keep all packaging, labels, shipping materials, and the damaged goods for inspection.

Claims involving visible damage, incorrect items, incorrect color, visible defects, or shortages must be submitted to EBI in writing within 10 calendar days after delivery and before the goods are cut, washed, processed, resold, or altered.

The claim should include:

  • Customer name
  • Invoice or sales order number
  • Product number
  • Color
  • Roll or lot information, when available
  • Quantity affected
  • Description of the issue
  • Clear photographs or videos
  • Photographs of packaging and shipping labels, when applicable
  • A fabric sample, if requested by EBI

Failure to provide timely notice may result in denial of the claim to the fullest extent permitted by law.

Submitting a shipping claim does not authorize the customer to return the goods, deduct amounts from an invoice, dispose of the goods, or issue a chargeback.

 

SECTION 9 - INTERNATIONAL SHIPPING

International orders, including international color-card and swatch-card requests, may be subject to shipping charges, customs duties, taxes, import fees, brokerage fees, tariffs, inspections, documentation requirements, and other charges imposed by the destination country or carrier.

Unless otherwise stated in writing, the customer is responsible for all customs duties, taxes, import fees, brokerage fees, tariffs, shipping charges, and other charges related to international shipments.

EBI is not responsible for delays caused by customs, border inspections, import restrictions, government action, international carrier delays, or incomplete customer-provided import information.

The customer is responsible for confirming that the products may be lawfully imported, used, labeled, sold, or distributed in the destination country.

 

SECTION 10 - RETURNS AND RETURN SHIPPING

No return will be accepted without prior written authorization from EBI.

If a return is approved, EBI will provide instructions on how and where to send the item.

Items sent back to EBI without prior written authorization will not be accepted and may be refused, returned to the customer, or held at the customer’s expense.

The customer is responsible for return shipping costs unless EBI agrees otherwise in writing.

Approved nondefective returns may be subject to:

  • A 20% restocking fee
  • Original shipping charges
  • Return freight
  • Inspection charges
  • Repacking charges

Refunds or credits will be issued only after EBI receives and inspects the returned goods.

 

SECTION 11 - FINAL SALE ITEMS

Except where required by law or approved by EBI in writing, the following items are final sale and are not returnable:

  • Cut yardage
  • Cut goods
  • Remnants
  • Samples
  • Swatches
  • Color cards
  • Clearance items
  • Sale items identified as final sale
  • Custom colors
  • Custom-dyed goods
  • Printed goods
  • Special orders
  • Factory orders
  • Goods that have been washed, cut, sewn, printed, sublimated, dyed, treated, processed, or altered
  • Goods damaged through improper handling or storage
