Refund policy

This Refund Policy applies to purchases made from EBI Fabrics Corp. (“EBI,” “we,” “us,” or “our”). This policy should be read together with our Terms and Conditions of Sale and Website Use.

 

Because fabric may be cut, prepared, ordered, or produced specifically for a customer, not all items are eligible for return.

 

SECTION 1 - RETURN REQUESTS

No return will be accepted without prior written authorization from EBI.

Please include the following information with your request:

  • Customer name
  • Invoice or sales order number
  • Product number
  • Color
  • Quantity
  • Reason for return
  • Photos, if applicable
  • Proof of purchase

If your return request is approved, we will provide instructions on how and where to send the item.

Items sent back to EBI without prior written authorization will not be accepted and may be refused, returned to the customer, or held at the customer’s expense.

Returns must be sent to the return address provided by EBI after return authorization is approved.

 

SECTION 2 - ELIGIBILITY FOR APPROVED RETURNS

Approved returns must be:

  • Unused
  • Uncut
  • Unwashed
  • Unaltered
  • Unprocessed
  • Properly packaged
  • In resalable condition
  • Accompanied by proof of purchase

EBI reserves the right to inspect all returned goods before issuing any refund or credit.

A return authorization does not guarantee that a refund or credit will be issued.

 

SECTION 3 - FINAL SALE AND NON-RETURNABLE ITEMS

Except where required by law or approved by EBI in writing, the following items are final sale and are not returnable:

  • Cut yardage
  • Cut goods
  • Remnants
  • Samples
  • Swatches
  • Color cards
  • Clearance items
  • Sale items identified as final sale
  • Custom colors
  • Custom-dyed goods
  • Printed goods
  • Special orders
  • Factory orders
  • Goods that have been washed, cut, sewn, printed, sublimated, dyed, treated, processed, or altered
  • Goods damaged through improper handling or storage

SECTION 4 - RESTOCKING FEE AND RETURN COSTS

Approved non-defective returns may be subject to:

  • A 20% restocking fee
  • Original shipping charges
  • Return freight
  • Inspection charges
  • Repacking charges

Original shipping charges are nonrefundable unless EBI determines that the return is due to EBI’s error or another reason required by applicable law.

The customer is responsible for return shipping costs unless EBI agrees otherwise in writing.

 

SECTION 5 - DAMAGES, SHORTAGES, AND INCORRECT ITEMS

Please inspect your order promptly upon delivery.

Claims involving visible damage, incorrect items, incorrect color, visible defects, or shortages must be submitted to EBI in writing within 10 calendar days after delivery and before the goods are cut, washed, processed, resold, or altered.

The claim must include:

  • Customer name
  • Invoice or sales order number
  • Product number
  • Color
  • Roll or lot information, when available
  • Quantity affected
  • Description of the issue
  • Clear photographs or videos
  • Photographs of packaging and shipping labels, when applicable
  • A fabric sample, if requested by EBI

Failure to provide timely notice may result in denial of the claim to the fullest extent permitted by law.

The customer must preserve the goods, packaging, labels, and related evidence while the claim is being reviewed.

Submitting a claim does not authorize the customer to return the goods, deduct amounts from an invoice, dispose of the goods, or issue a chargeback.

 

SECTION 6 - CONCEALED DEFECTS

A claimed defect that could not reasonably have been discovered during the initial inspection must be reported promptly after discovery.

No concealed-defect claim may be submitted more than 30 days after delivery, except where a longer period is required by applicable law or an express written warranty.

The customer must stop using the affected goods immediately after discovering a suspected defect.

Continued cutting, manufacturing, processing, resale, or use after discovering a suspected defect may reduce or eliminate any available remedy.

 

SECTION 7 - CUSTOMER INSPECTION AND TESTING

Customers are responsible for inspecting and testing all fabric before cutting, washing, printing, dyeing, sublimating, heat transferring, sewing, treating, manufacturing, or otherwise altering the goods.

Testing may include, as applicable:

  • Color and shade approval
  • Colorfastness
  • Crocking
  • Bleeding
  • Shrinkage
  • Stretch and recovery
  • Opacity
  • Pilling
  • Abrasion
  • Chlorine resistance
  • Water repellency
  • Heat resistance
  • Printing or sublimation compatibility
  • Washing and care performance
  • Finished-garment performance

Cutting, printing, washing, sewing, treating, incorporating, reselling, or otherwise using the goods constitutes acceptance of the goods, except where applicable law provides otherwise.

EBI is not responsible for processing, labor, cutting, sewing, printing, dyeing, manufacturing, replacement-garment, lost-production, recall, or similar costs when the customer failed to inspect and test the goods before use.

 

SECTION 8 - EXCHANGES

We do not guarantee exchanges.

If you need a different item, color, or quantity, please contact EBI to confirm availability.

If a return is approved, the customer may place a separate order for the new item. Availability, pricing, dye lots, and product specifications are not guaranteed to match a previous order.

 

SECTION 9 - REFUNDS AND CREDITS

We will notify you after we receive and inspect your approved return.

If the return is approved after inspection, EBI may issue a refund or credit, less any applicable restocking fees, shipping charges, return freight, inspection charges, repacking charges, or other permitted deductions.

Approved refunds will be issued to the original payment method unless EBI agrees otherwise in writing.

Please allow time for your bank, credit card company, or payment provider to process and post the refund.

SECTION 10 - VALID PRODUCT CLAIM REMEDIES

If EBI determines that products were defective, incorrect, or nonconforming when delivered, EBI may, at its option:

  1. Replace the affected goods;
  2. Issue a credit;
  3. Refund the purchase price paid for the affected goods; or
  4. Provide another remedy agreed to in writing.

Unless required by applicable law, EBI is not responsible for:

  • Cutting costs
  • Sewing costs
  • Printing costs
  • Sublimation costs
  • Dyeing costs
  • Finishing costs
  • Manufacturing costs
  • Garment replacement
  • Customer chargebacks
  • Lost orders
  • Lost production
  • Lost profits
  • Recall costs
  • Third-party labor or claims

 

SECTION 11 - EUROPEAN UNION 14-DAY COOLING-OFF PERIOD

If merchandise is shipped into the European Union and applicable law provides a 14-day cooling-off right, eligible customers may have the right to cancel or return their order within 14 days, for any reason and without justification.

Returned items must be in the same condition received, unused, uncut, unwashed, unaltered, properly packaged, and accompanied by proof of purchase.

This section does not apply to items that are excluded from cancellation or return under applicable law, including custom-made goods, special orders, goods made to customer specifications, or goods that have been cut, altered, or processed.
